Terms and conditions of use
Article 1: Purpose
The purpose of these “general terms and conditions of use” is to provide a legal framework for the terms and conditions for offering the services available on the Brasserie Dupont website, https://www.brasserie-dupont.com/, hereinafter referred to as “the Website”, and their use by the “User”.
The terms and conditions of use must be accepted by any User who wants to access the Website. By accessing and using the Website, you unreservedly accept these terms of use (hereinafter referred to as the “Terms and Conditions of Use”) and agree to abide by them.
- If the Terms and Conditions of Use stipulated in this contract are not accepted, the User must renounce access to the services offered by the Website;
- The Brasserie Dupont reserves the right to unilaterally modify the content of these Terms and Conditions of Use at any time;
- If any provision of these Terms and Conditions of Use is not applicable or conflicts with a mandatory legal provision, such inapplicability will not affect the validity or applicability of the other provisions;
- These Terms and Conditions of Use are specific conditions that relate solely to the use of the Website and must be supplemented, if necessary, by the general terms and conditions and cookie usage policy as well as by the Brasserie Dupont’s Privacy Policy, which remain fully applicable to the legal relationship between the Brasserie Dupont and the Users of the Website.
Article 2: Legal notice
The Website is run by the Brasserie Dupont SRL (hereinafter referred to as “the Brasserie Dupont” or “the Company”), whose registered office is at 7904 Tourpes, Rue Basse, 5, and registered with the Banque-Carrefour des Entreprises under number 0401.235.550 (Hainaut RPM, Tournai division).
Article 3: Definitions
The purpose of this clause is to define the various essential terms of these terms and conditions of use:
- User: this term refers to anybody who uses the Website or any of the services offered by the Website.
- User Content: this is the data transmitted by the User through the Website.
- Member: the User becomes a member when they have signed in to the Website.
- Username and password: this is all the information required for a User to sign in to the Website. The username and password allow the User to access services reserved for members of the Website. The password is confidential.
Article 4 : Access
The Website allows the User free access to the following services:
- Presentation of the products and services offered by the Brasserie Dupont;
- Presentation of special offers;
- News;
- Signing up for a user account;
- Access to your user account (customer);
- The ability to make online purchases (webshop);
- The ability to book an appointment to come to the brewery;
- The ability to contact the Brasserie Dupont via the contact form, or to send a CV to the Brasserie Dupont.
The Website is accessible free of charge at any location by any User with Internet access. All costs incurred by the User to access the service (computer hardware, software, Internet connection etc.) are the User’s responsibility.
The Brasserie Dupont makes every effort to ensure access to the Website insofar as it is possible.
However, this access may be interrupted, particularly in the event of maintenance and updates, failures or other technical reasons.
The Company therefore does not accept any responsibility for any failures, interruptions or errors on the Website, as well as for the consequences that may arise for the User or third parties. The User may never take action against the Brasserie Dupont if they cannot or have difficulties placing an order on the webshop or signing up for a visit to the brewery, due to a malfunction affecting the Website.
Article 5: Intellectual property
The Website, including the texts, photos, structure, layout, graphic components, presentation, logos, software and all other possible elements contained in the Website, are protected by the intellectual property rights of the Brasserie Dupont and any suppliers or partners. These intellectual property rights include, but are not limited to, copyright, related rights, rights relating to databases and trademark rights.
Other product or company names mentioned on the Website may be trademarks of their respective owners. Without the prior written authorisation of the rightful owner or the Brasserie Dupont, the User is prohibited from modifying, copying, distributing, communicating, translating, broadcasting, reproducing, publishing, licensing, transferring or selling the information, software, products or services obtained on these websites. They are also prohibited from creating work deriving from the above-mentioned elements.
Article 6: Liability and Force Majeure
The sources of the information, products and services presented on the Website are deemed to be reliable. However, the Brasserie Dupont does not give any guarantee that the information available on the Website is accurate or up to date. The information provided on the Website is for information purposes only. As a result, the User alone assumes full responsibility for the use of the information and content of this Website.
The User is responsible for keeping their password secret. Any disclosure of the password in any form is prohibited.
The User assumes all risks associated with the use of their username and password. The Website accepts no responsibility in this regard.
The Brasserie Dupont must be compensated for any use of the service by the User that directly or indirectly results in damage.
The absolute security and confidentiality of the data transmitted cannot be guaranteed. However, the Brasserie Dupont undertakes to use all necessary means to guarantee the security and confidentiality of the data.
The Brasserie Dupont cannot be held liable in the event of force majeure or an unforeseeable and insurmountable action by a third party. As a result, the Brasserie Dupont cannot be held responsible for the non-performance of contracts entered into thanks to access to its Website, or for the absence of a response to a request for a quote, contact or training.
The User may not claim any compensation following the interruption, suspension or modification of these terms and conditions of use.
Article 7: Hyperlinks
The websites to which users of the Website may be referred by means of hyperlinks remain the sole responsibility of the owners of those websites.
The Brasserie Dupont accepts no responsibility for any kind of material or information contained in or disseminated on these websites and for the processing of personal data carried out there. Indeed, the Company is only responsible for the processing of personal data carried out on its own Website, as outlined in the Privacy Policy. .
ARTICLE 8: Personal data
The information requested when registering for the webshop or for visits is necessary and essential for accessing certain services offered to the User. In particular, the email address may be used by the Brasserie Dupont for the administration and management of the service offered.
The Company guarantees that confidentiality is respected when personal data is collected and processed, and that this is done in accordance with (i) the European Regulation (EU) 2016/679 of 27 April 2016 (General Data Protection Regulation, which came into force on 25 May 2018 – the “ GDPR ”), and (ii) the Law of 30 July 2018 on the protection of natural persons with regard to the processing of personal data, repealing the Belgian law of 8 December 1992 regarding data protection for the processing of personal data that was in force up until that point.
For all matters relating to the processing of the User’s personal data, Users should refer to the Privacy Policy.
Article 9: Applicable law and jurisdiction
These Terms and Conditions of Use are governed entirely and exclusively by Belgian law.
For any dispute relating to the execution or interpretation of these Terms and Conditions of Use, only the courts of the jurisdiction of the Brasserie Dupont’s registered office will be competent.
